The Failures of The TRC
The Truth and Reconciliation Commission granted amnesty to several officers, including Willem Coetzee and Anton Pretorius, for the abduction of Simelane. However, they were denied amnesty for torture for failing to make a full disclosure of the facts. Crucially, none of the perpetrators ever applied for amnesty for her murder.
Despite a police docket being opened in 1996 and a prosecution finally being announced against four officers (Coetzee, Pretorius, Frederick Mong, and Msebenzi Radebe) in 2016, the case has been plagued by endless delays. Testimony before the Khampepe Commission in 2026 revealed that former Justice Minister Brigitte Mabandla allegedly ordered the National Prosecuting Authority to freeze all TRC-related cases, directly stalling the Simelane investigation. The family has also faced a "lost" police docket and a refusal by the state to pay the legal fees of the accused, which a court eventually ordered the state to do so.
Her case remains a powerful symbol of the unfinished business of the post-apartheid era, where those who committed atrocities on behalf of the state have yet to be fully held accountable.
